The Estate Planning, Probate & Trust Group
at Shannon Gracey

The Estate Planning, Probate & Trust Group at Shannon Gracey provides a full range of services as counsel to executors and trustees involved in the administration of estates and trusts.  Should an individual or family fail to plan or plan inadequately, the probate court costs, legal fees and taxes can create a heavy financial burden. Our attorneys offer high integrity and substantial depth of experience with trust formation and documentation, wealth transfer, business planning, and trust and estate administration.

Guardianship & Elder Law

In the event an individual is unable to manage his/her own affairs and advance directives have not been completed or are not successful, Shannon Gracey advises clients regarding all aspects of legal guardianship proceedings and the unique legal issues impacting incapacitated adults.  Our attorneys have experience representing guardians and trustees in contested or non-contested matters as well as experience with Medicaid and special needs trusts.

A Comprehensive Approach

The Estate Planning, Probate & Trust Group is comprised of financial and tax attorneys, providing clients with turn-key solutions.

  • Banking & Financial Institutions – We advise the owners of closely held businesses on cost-efficient ways to handle generational transitions, including shareholder agreements and restructuring.

  • Tax – Our attorneys help minimize taxes while preserving assets.   We specialize in tax advice essential to minimizing estate taxes, gift taxes, generation-skipping taxes, and income taxes for clients and their families.

  • Litigation / Alternative Dispute Resolution / Appellate - In some cases, good intentions are misunderstood, ignored or challenged. The result can be disputes within a family or disagreements between a beneficiary and a personal representative.  Our litigation attorneys are skilled at representing clients in all appropriate courts.  Our attorneys handle adversarial proceedings such as will contests, will construction proceedings and fiduciary controversies and have extensive experience resolving disputed claims of third parties, such as creditors or business partners.  If necessary, Shannon Gracey can appeal your case to the state Appellate and Supreme Courts or the Federal Circuit and the U.S. Supreme Court.
